Terms of Service

Effective 18/October/2026 · Last updated 18/October/2026 · Version 1.1

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Alan Salinas, an independent individual developer (persona física en el Régimen Simplificado de Confianza) resident in México, with address at Carretera Santiago Ocoyoacac, Edo. de Mex., México and tax registration (RFC) available on request ("Ditta", "we", "us", "our").

These Terms govern your access to and use of the Ditta mobile application, the website at ditta.app, and all related services and content (together, the "Service").

By creating an account, accessing or using the Service, you accept these Terms. The Ditta sign-in screen links to these Terms before you create your account. If you do not accept them, do not sign in or use the Service.

Our Privacy Policy is incorporated into these Terms by reference and describes how we handle your personal data.

2. Eligibility

To use the Service you must:

  • be at least 18 years old;
  • have the legal capacity to enter into a binding contract;
  • not be barred from using the Service under the laws of your country of residence;
  • not be located in the European Economic Area or the United Kingdom, where the Service is not offered (see Section 8.2 of our Privacy Policy); and
  • not be located in, or ordinarily resident in, a country subject to a comprehensive trade embargo, nor be listed on any restricted or prohibited party list.

The Service is not available to anyone under 18. This is a strict requirement, not a formality: the Service processes health information and prescribes physical exertion, and is designed for adults.

We may refuse, suspend or terminate access to anyone we reasonably believe does not meet these requirements.

3. Your account

Sign-in. Accounts are created exclusively through Sign in with Google or Sign in with Apple. We do not offer email-and-password accounts and we never see your provider password.

One account per person. You may hold one account. You may not create an account on behalf of anyone else, share your account, or transfer it.

Accuracy. The Service builds your training plan from the information you provide. You agree to give accurate information during onboarding and to keep it current — in particular your body metrics and injury history. Inaccurate information will produce an inappropriate and potentially unsafe training plan.

Security. You are responsible for the security of the Google or Apple account you sign in with, and for all activity under your Ditta account. Notify us at hi.ditta.app@gmail.com, opens in a new tab if you suspect unauthorized access.

Provider dependency. If you delete, lose access to, or disable the Google or Apple account you signed in with, you may permanently lose access to your Ditta account. We cannot restore access without a valid provider identity.

4. What the Service is

Ditta generates personalized strength and conditioning plans from the goal, experience level, lifestyle, injury history, body metrics, available equipment and schedule you provide during onboarding, and adapts those plans over time based on the sessions you complete.

The Service uses a combination of deterministic algorithms designed by us and artificial intelligence provided by a third party to generate plans, explanations and coaching guidance.

What the Service is not:

  • It is not a medical device, and has not been evaluated or approved by any health or drug regulatory authority in any country.
  • It does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation or nutritional therapy.
  • It does not replace a qualified physician, physiotherapist, dietitian, or in-person coach.
  • It does not supervise your technique, monitor your vital signs, or detect that you are injured, unwell or overtrained.

We may add, change, suspend or discontinue features at any time. If we permanently discontinue a material paid feature, Section 9.7 applies.

5. ⚠️ Health and Safety Disclaimer — read this carefully

The most important section

This section is the most important part of these Terms. The Ditta sign-in screen links to these Terms before you create your account. By signing in and using the Service, you confirm you have read and understood it.

5.1 Not medical advice

All content in the Service — training plans, exercise selection, prescribed loads, repetitions, rest periods, explanations, coaching notes, targets and AI-generated text — is general fitness and educational information only. It is not medical advice and must not be treated as such. Never disregard, avoid or delay obtaining professional medical advice because of something you read in the Service.

5.2 Consult a physician first

You should obtain clearance from a qualified physician before beginning this or any exercise programme, and in particular if any of the following applies to you:

  • you have or have had a heart condition, chest pain, high or low blood pressure, or a stroke;
  • you have diabetes, asthma, epilepsy, or any chronic or metabolic condition;
  • you have a musculoskeletal injury, joint problem or hernia, or have had surgery;
  • you experience dizziness, fainting or loss of balance;
  • you are pregnant, may be pregnant, or have given birth within the last six months;
  • you take medication affecting heart rate, blood pressure, balance or hydration;
  • you have been sedentary for an extended period, or are over 45 and unaccustomed to vigorous exercise;
  • you have or are recovering from an eating disorder, or have a difficult relationship with food, body weight or exercise volume.

5.3 Assumption of risk

Physical exercise carries inherent risks, including muscle strains, sprains, fractures, joint and tendon injury, dehydration, heat illness, cardiac events, aggravation of pre-existing conditions, and in rare cases death. These risks exist even when a programme is followed correctly and cannot be eliminated.

You voluntarily assume all such risks. You undertake any activity suggested by the Service at your own risk and on your own judgment.

5.4 Your responsibilities

  • Stop immediately and seek medical attention if you experience pain, chest discomfort, dizziness, shortness of breath disproportionate to effort, nausea, faintness, or any symptom that concerns you.
  • Do not train through pain. The Service cannot detect pain and will not tell you to stop.
  • Use correct form. The Service does not observe or correct your technique. If you are unfamiliar with an exercise, learn it under qualified in-person supervision before loading it.
  • Use appropriate loads. Prescribed weights are estimates. Reduce them whenever they exceed what you can safely control.
  • Use safe equipment. Verify equipment is in good condition, correctly assembled and appropriate for you. Use safety bars, clips and a spotter where appropriate.
  • Do not exceed your limits in pursuit of streaks, achievements or any other motivational feature of the Service. These are motivational elements, not training instructions, and completing them is never more important than your health.
  • Rest and recover. Rest days are part of the programme. Ignoring them increases injury risk.

5.5 Injury data limitations

You may record injury areas during onboarding, and the Service will attempt to avoid or substitute exercises that commonly load those areas. This is a general heuristic, not a clinical assessment. It cannot account for the nature, severity, stage or specific mechanics of your injury. If you are injured or in rehabilitation, follow the guidance of your treating clinician over anything the Service suggests.

5.6 AI-generated content

Parts of the Service are generated by artificial intelligence and may be inaccurate, incomplete, out of date, internally inconsistent, or inappropriate for your circumstances. Always apply your own judgment. Do not rely on AI-generated content as the sole basis for any decision affecting your health.

5.7 No guarantee of results

Individual results depend on genetics, nutrition, sleep, stress, adherence, prior training history and other factors outside our control. We make no representation or warranty that you will achieve any particular result in strength, body composition, endurance, weight or appearance.

6. Licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Ditta app on a device you own or control, for your own personal, non-commercial use.

This licence transfers no ownership. All rights not expressly granted are reserved.

7. Acceptable use

You agree not to:

  1. use the Service for any unlawful purpose, or in breach of any applicable law or regulation;
  2. use the Service to train, coach or prescribe for other people on a commercial basis, or to resell, redistribute or make the Service available to third parties;
  3. copy, scrape, mirror, frame or systematically extract content, exercise data or generated plans from the Service, including by automated means;
  4. reverse engineer, decompile or disassemble the app, or attempt to derive its source code, algorithms or prompts, except to the extent this restriction is prohibited by applicable law;
  5. circumvent, disable or interfere with security features, rate limits, paywalls, entitlement checks or trial restrictions;
  6. use the Service to build, train or evaluate a competing product, dataset or machine-learning model;
  7. submit content that is unlawful, defamatory, harassing, obscene, hateful, or that infringes anyone's rights;
  8. attempt to gain unauthorized access to any account, system or network associated with the Service;
  9. transmit malware, conduct denial-of-service attacks, or otherwise impair the operation or integrity of the Service;
  10. misrepresent your identity, age or health status, or impersonate any person;
  11. use the Service to promote, facilitate or reinforce disordered eating, extreme caloric restriction, unsafe rapid weight loss, or compulsive exercise;
  12. create multiple accounts to obtain additional free trials or otherwise abuse promotional offers.

We may investigate suspected violations and may suspend or terminate your account, with or without notice, where we reasonably believe a violation has occurred.

8. Content and intellectual property

8.1 Our content

The Service — including its software, design, user interface, exercise library, illustrations and animations, algorithms, configuration data, text, trademarks, logos and the name "Ditta" — is owned by us or our licensors and protected by intellectual property law. Nothing in these Terms grants you any right in it.

8.2 Your content

You retain ownership of the data and content you submit ("Your Content"), including your profile information, logged sessions, notes and feedback.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt and display Your Content solely to operate, maintain, secure and improve the Service for you, and to comply with law. This licence ends when Your Content is deleted, except for anonymized and aggregated data that can no longer identify you, and copies retained as described in our Privacy Policy.

You represent that you have the right to submit Your Content and that it infringes no third-party rights.

8.3 Feedback

If you send us suggestions, ideas or feedback about the Service, we may use them without restriction, without compensation and without any obligation to you. You are not required to send us feedback.

8.4 Generated plans

Training plans generated for you are provided under the licence in Section 6, for your personal use. They are produced from shared underlying content and templates, may resemble plans generated for other users, and are not exclusive to you.

9. Free trial, subscriptions and payment

9.1 Free trial

New users who choose the annual plan are offered a 7-day free trial of Ditta Pro. The monthly plan has no free trial. The trial is limited to one per person, per Apple ID and per Google account. We may modify or withdraw trial offers at any time for new users.

Unless you cancel at least 24 hours before the trial ends, the trial converts automatically into a paid subscription and your account will be charged.

If you subscribe while a free trial is still running, the unused portion of the trial is forfeited where the applicable app store requires it.

9.2 Subscriptions

Ditta offers auto-renewing subscriptions. Prices are shown in the app in your local currency at the point of purchase and vary by country. Prices displayed in the app prevail over any other source. Applicable taxes may be added or included depending on your jurisdiction.

9.3 Billing and automatic renewal

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
  • Subscriptions renew automatically at the end of each term unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price for that plan.
  • We do not process payments ourselves and never receive your card details. Billing, receipts and taxes are handled entirely by Apple or Google.

9.4 Managing and cancelling

You can manage or cancel your subscription at any time:

  • iOS: Settings → [your name] → Subscriptions
  • Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions

Cancellation takes effect at the end of the current billing period, and you keep access until then. We cannot cancel a store-billed subscription on your behalf.

Cancelling is separate

⚠️ Deleting the Ditta app, or deleting your Ditta account, does NOT cancel your subscription. You must cancel it in the App Store or Google Play, or you will continue to be charged.

9.5 Refunds

All purchases are processed by Apple or Google, and refunds are governed by their policies, not ours. Requests must be submitted to them directly:

  • Apple: reportaproblem.apple.com
  • Google: play.google.com/store/account

We generally cannot issue refunds for store-billed purchases. Where we do have discretion, refunds are at our sole discretion and create no obligation for future cases.

Statutory rights are unaffected. Consumers in Mexico retain all rights under the Ley Federal de Protección al Consumidor.

9.6 Price changes

We may change subscription prices. Changes apply from your next renewal, never retroactively. We will give at least 30 days' notice by in-app notice and, where applicable, email, and — where required by the App Store or Google Play — you will be asked to consent before the new price takes effect. If you do not accept, cancel before renewal.

9.7 Changes to paid features

If we permanently discontinue a material feature of a paid plan during a term you have already paid for, we will offer either a reasonable substitute or a pro-rata refund of the unused portion, subject to the app store's processing.

10. Account termination and deletion

10.1 Deletion by you

You may delete your account at any time from Profile → Account → Delete Account.

  • Your account is deactivated immediately.
  • If you sign in again with the same Google or Apple account within 30 calendar days, the deletion is cancelled and your account and data are fully restored.
  • If you do not sign in within 30 days, your personal data is permanently and irreversibly deleted, subject only to the limited exceptions in our Privacy Policy.
  • Deletion does not cancel your subscription and does not entitle you to a refund of amounts already paid. Cancel your subscription separately (Section 9.4).

10.2 Suspension or termination by us

We may suspend or terminate your access — with notice where reasonably practicable, and immediately where necessary — if:

  • you materially breach these Terms, including Section 7;
  • we are required to do so by law or by a competent authority;
  • your use creates a security, legal or safety risk to us, other users or third parties;
  • your payment fails or is reversed; or
  • we discontinue the Service (Section 10.3).

Where we terminate for a reason not attributable to your breach, and you have paid for a period not yet used, we will provide a pro-rata refund of the unused portion where the app store permits.

10.3 Discontinuation of the Service

If we decide to discontinue the Service entirely, we will give at least 60 days' notice, stop new charges, allow you to export your data, and provide pro-rata refunds for unused prepaid periods where required by law.

10.4 Effect of termination

On termination, your licence under Section 6 ends immediately. Sections 5, 8.1, 8.3, 12, 13, 14, 20 and 21 survive termination.

11. Third-party services

The Service depends on third parties, including Apple, Google, Supabase, OpenAI, RevenueCat and Expo. We are not responsible for their acts, omissions, availability or terms. Your use of the App Store or Google Play is subject to that party's own terms and privacy policy.

Ditta does not currently integrate with Apple Health, Google Fit or any wearable device. If we add such an integration, we will update these Terms and our Privacy Policy before doing so.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind.

We expressly disclaim all warranties, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that:

  • the Service will be uninterrupted, timely, secure or error-free;
  • plans, calculations, load prescriptions, metric estimates or AI-generated content will be accurate, complete, current or suitable for you;
  • the Service will meet your requirements or produce any particular fitness result;
  • defects will be corrected, or that the Service is free of harmful components.

No advice or information obtained from us or through the Service creates any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties. There, the exclusions above apply only to the extent permitted, and you may have rights these Terms cannot limit — in particular non-waivable consumer rights under the laws of Mexico or of your country of residence.

13. Limitation of liability

To the maximum extent permitted by applicable law:

13.1 We will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service, whether based on contract, tort (including negligence), strict liability, statute or any other theory, and whether or not we were advised of the possibility of such damages.

13.2 We will not be liable for any personal injury, illness, aggravation of an existing condition, disability or death arising from your participation in physical exercise, except where such liability results from our gross negligence or wilful misconduct, or cannot be excluded by law.

13.3 Our total aggregate liability for all claims arising out of or relating to the Service in any 12-month period will not exceed the greater of (a) the total amount you actually paid for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

13.4 Exceptions. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer protection law. If you are a consumer, your statutory rights under the laws of Mexico or of your country of residence are unaffected.

13.5 You acknowledge that the pricing of the Service reflects this allocation of risk, and that these limitations are an essential basis of the agreement between us.

14. Indemnification

You agree to indemnify, defend and hold harmless Alan Salinas de los Santos and any contractors or agents acting on our behalf from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with:

  • your use of the Service;
  • your breach of these Terms or of any applicable law;
  • Your Content;
  • your infringement of any third-party right; or
  • any injury or damage suffered by you or a third party as a result of activities you undertook based on the Service.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, at your expense, in which case you agree to cooperate with us.

15. Changes to these Terms

We may modify these Terms. We will update the "Last updated" date and, for material changes, give at least 30 days' notice by in-app notice and, where we have a usable address, by email.

Material changes take effect on the date stated in the notice. Continuing to use the Service after that date means you accept the revised Terms. If you do not accept them, stop using the Service and delete your account before the effective date; where a material change disadvantages you and you cancel for that reason, we will refund the unused prepaid portion of your current term where required by law.

Changes required by law or by an app store may take effect immediately.

16. Notices

We may send you notices by in-app message, push notification (if enabled), or email to the address associated with your account. You are responsible for keeping that address current.

Legal notices to us must be sent to hi.ditta.app@gmail.com, opens in a new tab and to the business address in Section 1.

17. Google Play

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Purchases are processed under Google Play Billing and are subject to Google's payment and refund policies. Google is not responsible for the Service and provides no warranty in respect of it.

18. Apple App Store — additional terms

This Section applies if you obtained the Ditta app from the Apple App Store. In the event of conflict, this Section prevails over the rest of these Terms with respect to Apple.

  1. Acknowledgement. These Terms are concluded between you and Alan Salinas only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
  2. Scope of licence. The licence granted in Section 6 is limited to a non-transferable licence to use the app on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services.
  4. Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. Apple will have no other warranty obligation whatsoever with respect to the app.
  5. Product claims. We, not Apple, are responsible for addressing any claims relating to the app or your possession and use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property claims. In the event of a third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims relating to the app should be directed to: Alan Salinas, Carretera Santiago Ocoyoacac, Edo. de Mex., México, hi.ditta.app@gmail.com, opens in a new tab.
  9. Third-party terms. You must comply with applicable third-party terms of agreement when using the app.
  10. Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

19. Force majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, epidemics, labour disputes, failures of internet or telecommunications infrastructure, power outages, cyberattacks, changes in law, or the acts or omissions of third-party providers.

20. Governing law and disputes

20.1 Governing law

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of the México, without regard to conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

20.2 Informal resolution first

Before commencing any formal proceeding, you agree to contact us at hi.ditta.app@gmail.com, opens in a new tab with a written description of the dispute and the relief sought, and to allow 30 days for us to attempt to resolve it informally. Most issues are resolved at this stage.

20.3 Courts

Subject to Section 20.4, the competent courts of Ocoyoacac, Estado de México, Mexico will have exclusive jurisdiction.

If you are a consumer, you may also bring proceedings in the courts of your country of residence, and we will bring proceedings against you only in those courts.

20.4 Consumer authorities

  • Mexico: nothing in this Section limits your right to submit a complaint to the Procuraduría Federal del Consumidor (PROFECO).
  • Other jurisdictions: you retain any right to complain to your local consumer protection authority.

21. General

Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented in the app for a specific feature, constitute the entire agreement between you and us regarding the Service, superseding all prior agreements and understandings.

Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions continue in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign them to a legal entity we form to operate the Service, or in connection with a sale or transfer of the Service, on notice to you.

No third-party beneficiaries. Except for Apple under Section 18.10, there are no third-party beneficiaries to these Terms.

Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between us.

Language. These Terms are drafted in English. Any translation is provided for convenience only; in the event of conflict, the English version prevails, except where applicable consumer law in your country requires otherwise.

Headings. Section headings are for convenience only and do not affect interpretation.
